Terms of Use and Subscription

1. Our service

Search Heavy Equipment is an online service providing a searchable index of equipment listings published by independent dealerships. We organize equipment information to help you find listings and continue to the original seller. Search Heavy Equipment does not own the indexed equipment, act as the seller, or represent that a dealership has joined or endorsed our service.

These terms apply to searchheavyequipment.com and the customer app at app.searchheavyequipment.com. Use the service only if you can enter into a binding agreement and are at least 18 years old. By creating an account or using the service, you agree to these terms. Our Privacy Policy explains how we handle personal information.

The product is access to an online equipment research scanner for the selected period and coverage. No equipment, physical shipment, downloadable software package, brokerage or appraisal is included. Review admitted inventory, the plan, period and requirements before subscribing. A subscription does not guarantee a particular listing, complete regional coverage or a purchasing outcome.

These terms apply to purchases made on or after the effective date. Earlier purchases remain subject to the terms accepted at purchase.

2. Your account

Provide accurate account information, keep your sign-in details private, and contact us if you suspect unauthorized access. You are responsible for the activity you authorize through your account. Do not impersonate a dealership, another person, or an authorized representative.

A free account does not grant subscriber access. Access to protected dealer information depends on your active coverage and account status.

3. Equipment information and independent sellers

Inventory, prices, hours, condition and location may change between scans. A listing in the scanner is not confirmation that the equipment is still available, inspected, accurately described or suitable for your intended use. Verify current details directly with the seller before making a decision or payment.

Any purchase, inspection, financing, shipping or other transaction you arrange with a seller is between you and that seller. Their terms and privacy practices apply on their websites. Our links do not guarantee a seller's performance or equipment quality.

Currency conversion is indicative. Confirm the original listing currency and the actual exchange rate and charges that apply to your transaction.

4. Subscriptions, renewal and cancellation

Scanner subscriptions use CREEM's hosted checkout. Review your selected plan, billing period, coverage and final total before paying. Saving a plan does not authorize a charge.

One State costs USD 50 per month or USD 500 per year. Three States costs USD 75 per month or USD 750 per year. Full Access costs USD 100 per month or USD 1,000 per year. Annual prices include two months at no additional cost compared with twelve monthly payments. Review your selected plan, period, coverage and the final payment total before checkout.

Subscriptions renew automatically for the selected monthly or annual period unless renewal is canceled before the next payment.

CREEM handles payment as Merchant of Record. Review its final total before paying. A scanner subscription does not purchase or reserve equipment. CREEM issues payment confirmation and invoices for transactions it processes. Search Heavy Equipment provides the scanner and support; we do not collect full card numbers or card security codes.

Paid access begins only after we verify payment and purchased coverage. A redirect alone does not activate access. If confirmation is delayed, refresh My Subscription or contact support with the purchase reference. Do not start a second payment to resolve a pending checkout.

One State covers one selected state with admitted inventory, Three States covers up to three selected states, and Full Access covers all admitted scanner inventory. Purchased coverage applies to admitted listings rather than every dealership or piece of equipment in a state. Saving a different draft does not change purchased coverage; contact support about a change before starting another subscription. No automatic mid-period state swap or upgrade is promised.

Cancel renewal in My Subscription. Confirmed cancellation takes effect at the end of the verified paid period and does not automatically request a refund. Paid access remains through that period unless a refund, dispute, account restriction or applicable requirement ends it earlier. Contact support before the next payment if cancellation cannot be confirmed.

5. Payments and no-refund policy

Subscription payments are non-refundable, including renewals and unused portions of a billing period, except as required by applicable law or provided under CREEM's buyer terms. Contact support about incorrect charges or missing paid access.

Report an incorrect or duplicate charge, missing paid access or a service that does not match the purchased description to [email protected] with the purchase reference and explanation. We investigate the payment and access facts and help resolve the issue. If it cannot be resolved, applicable rights and remedies remain available. Cancellation alone does not reverse a payment, and submitting a request does not guarantee approval.

CREEM processes refunds for its transactions under its buyer terms and procedures. Posting times depend on the payment provider and method. A verified refund or payment dispute may suspend or end the related access.

Using this website, saving a selection or subscribing does not by itself waive rights that cannot be waived. No waiver intended for a downloadable-file product is applied automatically to this online service. Any legally required consent must be presented and obtained through the applicable purchase flow.

6. Acceptable use

A valid account and any purchased coverage permit lawful equipment research within your access. You may review information and continue to the original listing to discuss current details with its seller. A subscription is a limited right of access for its verified paid period, not ownership of the software, our service or third-party content.

Keep credentials private. Do not share access to circumvent coverage or account limits, impersonate others, bypass protections, attempt unauthorized access, interfere with the service or use information obtained here for unsolicited bulk messages. Do not scrape protected areas, extract content in bulk, or redistribute our service or protected material without the necessary rights and authorization.

We may restrict access when reasonably necessary to protect accounts, investigate misuse or comply with applicable law. If you believe a restriction is mistaken, contact us.

7. Ownership, corrections and removal

Equipment facts, business names, original descriptions, images and trademarks may originate from independent dealerships and other rights holders. Their rights remain with them. We do not claim affiliation, endorsement or ownership of their protected materials. A reference or original listing link does not grant a right to copy third-party content.

We organize research information and attribute sources without claiming exclusive ownership of the underlying equipment facts. Restrictions on copying protected materials do not prevent lawful independent research or use of unprotected facts.

Representatives and rights holders may contact [email protected] or use Dealership Requests for a correction, exclusion or rights concern. Identify the business or page, original source, specific material, reason and your authority to make the request. We review the report and, where appropriate, correct or remove the identified material. This route is not presented as a registered statutory notice agent or a guarantee of a particular legal procedure.

8. Broker and appraisal requests

Search Heavy Equipment receives broker and appraisal inquiries, reviews the information supplied and coordinates follow-up with an independent provider. With your permission, we share the contact details and request information needed for that follow-up. A scanner subscription is not required to submit an inquiry.

Submitting a request does not book a service, guarantee a provider's availability or create a brokerage, appraisal or agency engagement. The independent provider confirms its identity, scope, fees and responsibilities with you under a separate agreement before work is accepted. Search Heavy Equipment does not issue the professional appraisal or perform the brokerage work through this request form.

9. Service availability and changes

We use reasonable efforts to operate the service, but do not guarantee uninterrupted access, complete inventory coverage or the accuracy of third-party listing information. Nothing in these terms limits rights or remedies that cannot be limited under applicable law.

We may update these terms as the service changes. The effective date identifies the current version. We will give notice of material changes that affect account or subscription use before asking you to accept those changes.
